Why Mekong Counsel

How We Approach Each File

Station-by-Station Clarity

Each file moves through defined stages. You receive a written summary at each stage so there are no surprises about what has been done or what remains.

Complete Document Preparation

We prepare both employee and employer documents to the Department of Employment's current standards, reducing the chance of requests for additional information.

Employer-Side Knowledge

Thai work permit law places obligations on the employer as much as the employee. Our counsel covers both sides so the company remains in good standing throughout.

BOI and Multi-Authority Cases

Senior executive and BOI-routed cases require coordination across several offices. We manage that liaison so the process does not stall between authorities.

Renewal and Compliance Planning

Work permits and related visas carry annual renewal obligations. We track these dates and provide timely reminders so permits do not lapse through oversight.

Plain-Language Communication

Regulatory requirements can read densely. We translate each requirement into clear instructions so both HR teams and individual employees know exactly what is needed from them.

Common Questions

Frequently Asked Questions

Who needs a work permit in Thailand?
Any foreign national working in Thailand — including those on long-term business visas — is required to hold a valid work permit issued by the Department of Employment. This applies regardless of whether the role is full-time, part-time, or project-based. Certain BOI-promoted companies and free-trade-zone entities have separate procedures but the requirement itself remains. We help assess which route and which permit category fits a given situation.
What documents does the employer need to provide?
The employer's file typically includes company registration documents, a certified list of shareholders, audited financial statements, and evidence that the company employs a certain number of Thai nationals relative to foreign staff. The exact requirements depend on the company structure and permit category. We review the employer's situation at the outset and provide a precise checklist before preparation begins.
How long does the work permit process typically take?
Standard applications at the Department of Employment in Bangkok are generally processed within seven to ten business days once the file is accepted as complete. BOI one-stop service cases can sometimes be faster. Delays most often arise from incomplete employer documentation or requests for supplementary information from the case officer. Thorough preparation at the outset is the most reliable way to keep the timeline on track.
Does the work permit cover all types of employment activity?
A Thai work permit is tied to a specific employer and a specific permitted occupation. Working for a different employer or performing work outside the stated occupation without an amended or separate permit is not in compliance. If an employee's role changes or they move to a new entity, we advise on the correct procedure — which may be an amendment, a new application, or cancellation and reapplication.
What is the relationship between a work permit and a visa?
A work permit and a non-immigrant B visa are separate instruments. The visa allows the individual to remain in Thailand; the work permit authorises them to work. Both must be kept current, and their renewal cycles need to be managed in coordination. For BOI cases, the non-immigrant B visa and work permit are processed together at the one-stop service centre. Our senior executive engagement covers both.
What does the Employer Compliance Programme involve?
The programme builds an internal system for managing permit applications and renewals across a team. We prepare standardised document templates that HR can reuse for each new hire, write an internal handbook explaining the employer's legal obligations, and produce a twelve-month filing calendar. The aim is to take the management of work permit compliance off the desk of individual managers and give the HR function clear procedures to follow.
Are your fees inclusive of government charges?
Our professional fees do not include official government filing fees, which are set by the Department of Employment and paid directly at the time of submission. We provide a clear breakdown of both our fee and the applicable government charges at the start of each engagement so there are no unexpected costs.
